The headline at the left-leaning Kentucky Lantern said, “Public money for non-public schools amendment meets bi-partisan resistance, but clears the house.” This refers to a constitutional amendment that would allow for some form of school choice to be enacted by the legislature. The reason the constitutional amendment is necessary is due to a Kentucky Supreme Court ruling that struck down a school choice plan called education opportunity accounts (EOA). The court said that since a tax deduction was given to businesses or individuals donating, it meant it was public money. Now that’s a big stretch by the court. Because the money wasn’t the states to begin with. However, if since the amendment passed, it will allow for such tax credits or other school choice plans to go into effect, without the threat of a veto by the court.
