Kentucky’s Council and Post Secondary Education had a policy that allowed any high school graduate in the commonwealth to qualify for in-state tuition regardless of their immigration status. The Department of Justice threatened a lawsuit and intervened. It recently announced it’s settled out of court with CPE. Attorney General Pam Bondi said “No state can be allowed to treat Americans like second-class citizens in their own country by offering financial benefits to illegal aliens.” Bondi pointed to a similar case in Texas where they won. It should be clear that illegal immigrants should not be rewarded with special benefits over legal residence and this includes in-state tuition at Kentucky colleges and universities. It’s simple but it’s something that every institution should embrace.
