Ballot measures in nine states proposed a new right to abortion in their state constitutions. While three states rejected these measures, the other six passed them. These measures are possible because of the 2022 Dobbs decision which repealed Roe v. Wade and sent the issue of abortion back at the states. And many have argued that the state level is where this issue belongs. Now, states like New York and Maryland that passed the measure to make abortion a constitutional right already had liberal abortion laws, but the bright spot is the state of Florida, where Amendment 4–which would have made a constitutional right to abortion up to viability—failed. Because of this, babies in Florida are safer.
