The Sixth Circuit Court of Appeals blocked Kentucky’s ban on dismemberment abortions. This is a late-term abortion procedure whose name implies how particularly gruesome it is. The court didn’t have a constitutional basis for its ruling. Nor did the 6th Circuit cite any laws that this ban would violate. Rather, the court ruled that banning the dismemberment of babies in the womb would “impose an undue burden” on the women. Of course, abortion isn’t mentioned in the Constitution or protected by it. This ban passed in the Kentucky State House and Senate by wide majorities in 2018. That we need such law is tragic, but not nearly as tragic as the injustice and brutality imposed on the child in the womb who has this particular procedure used on them. May God grant us mercy.
