At the direction of President Biden, the Center for Disease Control has unilaterally extended the eviction moratorium. This means that if a tenant is struggling to pay rent, the landlord cannot evict them. Of course, this brings hardship to landlords who also have bills to pay. Congress passed an eviction moratorium was last year. Then the CDC extended it, which was eventually challenged in court. If the CDC sought an extension once again, Justice Brett Kavanaugh said that they would need “specific congressional authorization (via new legislation).” But Biden is sweeping the Constitution under the rug and is utilizing powers he does not have. Not only will landlords suffer from this decision, but our Constitutional separation of powers will as well.
