A challenge to a recently enacted Kentucky law restricting vaping for health concerns has been rejected. Vaping lobbyists like the Kentucky Smoke Free Association claimed that the law was unconstitutional. But the Franklin County Circuit Court said that this action was within the legislature’s purview. Judge Thomas Wingate said that it’s constitutional to protect the health and safety of citizens. The General Assembly passed that law this year, largely targeted at vaping products that originate in countries with lax safety standards. Ironically, the same legislature has opened the door to legalizing “medical” marijuana. The problem is that smoking pot has its own health and safety issues. Medicinal cannabis hasn’t been run through the appropriate medical protocols to determine dosages and side effects. Of course, regulating vaping is good and to be consistent, the legislature should be equally concerned about marijuana.
