The Kentucky Supreme Court struck down a law that funds charter schools in the commonwealth. Charter schools are essentially public schools minus the red tape. The Court said that Kentucky’s Constitution limits public education dollars to the defined “common school” system and that charter schools don’t fit this definition. According to education policy expert Gary Houchens, under the court’s logic “the Gatton Academy, Craft Academy, Governor’s Scholars programs, and Kentucky Schools for the Blind and Deaf are now all illegal.” This may be the case. One thing is clear, Kentucky families are denied education options for their children offered in 46 other states. If any change happens, it’s up to the state legislature to amend the state constitution to address this.
