A Kentucky judge halted the state legislature’s attempt to impeach a sitting Lexington judge. The state House had accused Fayette Circuit Judge Julie Muth Goodman of ignoring established law in her rulings. Franklin Circuit Court Judge Phillip Shepherd said that the House’s impeachment resolution against did not meet the constitutional standard. Shepherd said in his ruling that “The legislature has now asserted the power to remove judges and justices from office because it disagrees with their rulings. Such unchecked and unreviewable power would destroy the system of checks and balances.” Shepherd is right that our government has checks and balances, but in this case, the legislature asserts it is the proper check on the judiciary. The case is being reviewed by the Ky State Supreme Court.
